Terms of service

Who we are

Cup of Leads is operated by DFX Intelligence and powered by the DFX General. Contact: hello@dfxintel.com. Using the service means you accept these terms, and if you are accepting them for a company you are confirming you can bind it.

Who may use it

You have to be 16 or older and using this for a business purpose. One account per person. If we close your account, you may not open another without asking us first.

What the service does

You describe the kind of customer you want to reach. We research the market and return a small number of companies that match, with our reasoning, any current signals we can evidence, and a business contact where one is findable from public and licensed data sources.

What we do not promise

Research is research. We do not guarantee that a company will be interested, that a contact is current, or that an email address will deliver. We label how confident we are in every address and we never present an unverified one as verified. We do not knowingly return invented companies, people or claims, and if you find one we want to hear about it.

The free cup

One free cup per calendar day, Eastern time, which is a day you either used or did not rather than a rolling clock. A cup is a fixed number of leads, shown in the product. We may change how many leads a cup holds and how often the free one arrives, and we may pause free use entirely if the service is being abused or the cost becomes unsustainable. A brew that fails, that only asks you a clarifying question, or that returns fewer results than our own minimum does not consume your cup.

Cups you buy

Packs buy cups beyond the free one. They do not expire while your account is open. A cup is consumed when leads are delivered to you, not when a brew is started, and a brew that under delivers is charged for what it poured rather than what it was asked for. Cups have no cash value, cannot be transferred or exchanged for money, and prices are shown before you pay. You are responsible for any tax that applies where you are.

Cups you earn by inviting people

You can share a link. When somebody genuinely new signs up through it and brews their first cup, one free cup lands in your account, up to three a day. The rules, stated plainly because a reward with hidden rules is worse than no reward:
  • It pays once per invited person, whichever proof arrives first. Two ways of proving the same friend is real is still one friend.
  • They have to be new. An existing account following your link is a visit, not a signup, and pays nothing.
  • You cannot invite yourself, including from a second address on the same network. You still get the product, you just do not mint a cup out of it.
  • Do not post invite links as spam, buy traffic to them, or offer anything in exchange for a signup. That is a reason for us to withhold cups and disable the link.
  • Earned cups have no cash value. We may change the amount, the cap or the whole programme, and we will not take back cups you have already earned honestly.

Refunds

If a paid brew delivers results you believe are not what you asked for, tell us within 30 days and we will refund the cups or the payment. We would rather refund than argue about a lead. Refunds return cups to your balance where possible; where a payment is reversed, any unspent cups from that purchase are removed. If you dispute a charge with your bank rather than asking us, we may suspend the account until it is resolved.

How you may use the results

The contacts we surface are business contacts, provided for legitimate business to business outreach. When you contact them you are the one deciding to, so you are responsible for the law that applies to you, including rules on electronic marketing, data protection and do not contact registers. You must honour an opt out request you receive, and identify yourself honestly in any message you send.

You may use the results inside your own business, including in your own outreach and your own CRM. You may not resell or redistribute them as a list product, publish them as a directory, use them for consumer marketing, or use them to harass anybody or do anything unlawful.

Using the service itself

Do not scrape the product, automate access to it outside anything we publish as an API, attempt to get around the free cup limit with multiple accounts or cleared cookies, probe or attack the infrastructure, or resell access to it. We may rate limit or pause any account that is costing more to serve than it is possible to justify, and we will tell you why.

Your account

We sign you in with an emailed link or a six digit code rather than a password. Anyone with that link or code can access your account until it is used or expires, so treat them as you would a password and tell us at once if you think somebody else has one. You can delete your account and everything in it at any time from your account page.

Who owns what

You own what you write: the markets you describe stay yours. We own the product, the interface, the research methods and everything we have built to produce a result, and nothing here transfers any of that to you. The results themselves are licensed to you, permanently and non exclusively, for the uses set out above. If you send us feedback we may act on it freely and without owing you anything for it.

Pages you reach from a newsletter, community or event

Some organisations give their audience a co-branded page here. Your agreement is with us, not with them: they are introducing you to the service, they do not operate it, and they are not responsible for what it finds. Everything in these terms applies to you in exactly the same way it applies to somebody who arrived at the front page.

A partner has an allocation of research we pay for. When it runs out for the month, the page says so and you still have your own free cup that day, so the page keeps working either way. We may pause or end a partner page at any time, including when the results it produces are not good enough to put in front of somebody’s members.

A partner receives aggregate information about their audience and never information about you. What that means precisely, and the minimum number of people behind any figure they see, is set out in the privacy policy.

If you run a partner page

If we give you a partner page and a dashboard, you may use the launch copy, the link and the QR code we generate to promote it to your own audience. You may not present the service as your own product, remove the Cup of Leads name from the page, or tell your audience that you can see what they searched for, because you cannot. You are responsible for having the right to send to the people you send to.

Changes to what your page searches for need our agreement before they take effect, because they change what we have to research and whether we can do it well. Your access can be ended at any time, and we will tell you why.

The General

If you choose to hand your leads to The General, you are asking us to transfer that information into a separate DFX Intelligence product with its own terms. We record that consent. Nothing transfers until you ask for it.

Availability

We do not promise the service will be uninterrupted. We depend on third parties for research, contact data, payment and delivery, and when one of them is unavailable we would rather pause and say so than take your cup for a result we cannot produce. We may change or discontinue features. If we discontinue the paid product entirely we will refund unused cups that were bought.

Suspension and closing an account

We may suspend or close an account that breaks these terms, that is being used to abuse the free tier, or where we are required to. Except in cases of abuse or a legal requirement, we will tell you first and give you a chance to fix it, and we will refund unused cups that were bought.

Disclaimers

The service is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose and non infringement, to the extent the law allows. We are a research tool, not a lawyer, and nothing here is legal advice about your outreach.

Liability

We will not be liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, data or business opportunity. Our total liability for any claim is limited to the greater of fifty United States dollars and what you have paid us in the twelve months before it arose. Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Indemnity

If somebody brings a claim against us because of how you used the results, including how you contacted somebody, you will cover the reasonable cost of defending it. We will tell you promptly about any such claim and will not settle it without asking you.

If we disagree

Email hello@dfxintel.com first. Most things end there, and we will engage properly for at least 30 days before anybody involves a court. If that fails, these terms are governed by the laws of the Commonwealth of Massachusetts, United States, and the state and federal courts of Suffolk County, Massachusetts have exclusive jurisdiction. Any claim has to be brought within one year of when you first knew about it.

Changes

We may update these terms. Material changes will be notified by email to account holders before they take effect. Continuing to use the service after that means you accept them. If you do not, close your account and we will refund unused cups that were bought.

The rest

If any part of this is unenforceable, the rest still stands. Not enforcing something once does not waive it. You may not assign these terms; we may, to a successor of the business, and this travels with it. These terms and the privacy policy are the whole agreement between us about the service.
